Learned standing counsel appears for respondents No. 1 to 3.  Learned counsel for the petitioner submits that by the impugned order passed by the District Magistrate  recovery has been directed from the salary of the petitioner without  drawing any proceedings in accordance with the U.P. Government Servant (Discipline and Appeal ) Rules, 1999. He submits that the  order has been passed on the basis of the report of the Tahsildar. In the report it has been mentioned that there is no signature of the petitioner for receiving the file of Smt. Rajendri Devi.  The submission needs scrutiny. Let a counter affidavit be filed within four weeks. List thereafter.

In the mean time no recovery shall be made from the petitioner in pursuance of the order dated  28.2.2007.
