Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for a writ of mandamus directing the respondents No. 1 and 2 to forthwith consider the claim of the petitioner for being appointed on the post of regular Collection Amin in Tahsil Khair, District Aligarh. Petitioner's case in the writ petition is that the petitioner has been working seasonal collection Amin with effect from 1998 on seasonal basis. He submits that the representation has been given by the petitioner for consideration of petitioner for regular appointment but no decision has yet been taken. Learned counsel for the petitioner further submits that there are posts vacant of regular Amins which can be filled by regular appointment of seasonal collection Amin. Under the U.P. Collection Amins Rules, 1974 as amended upto date 35% of the post of collection Amins are to be filled from the seasonal collection Amins as provided under the rules.
In the facts of the case ends of justice be served in disposing of the writ petition directing the respondents to consider the claim of the petitioner for regular appointment on the post of Collection Amin as represented by the letter dated 7.4.2007 as and when the process is taken for filling up 35% posts of Collection Amins from amonst the seasonal collection Amis.
With the above observation the writ petition is disposed of.
