This writ petition has been filed raising the grievance that the respondent no.4 wants to evict the petitioner from the residential accommodation provided to him by the respondent no.4 during the course of his employment as the services of the petitioner has been terminated and the matter is pending consideration in a reference before the Labour Court, Saharanpur. Petitioner claims that he has a  right to continue in possession of the accommodation provided by the respondent no.4 during the course of his employment till the matter is finalized by the Labour Court. In order to fortify the case of the petitioner, learned counsel for the petitioner has placed reliance upon the provision of Section 6E of the U.P. Industrial Dispute Act, 1947 and Clause 9 of the Sugar Standing Order.

Sri C.K. Rai, learned Standing Counsel appearing for the respondents except respondent no.4 submitted that as the matter is between the petitioner and the respondent no.4, both private parties, it would be appropriate that the respondent no.2 be directed to resolve the controversy instead of keeping the writ petition pending.

In view of the submissions of the learned Standing Counsel, we dispose of the writ petition requesting the respondent no.2 to consider the grievance of the petitioner and decide the same expeditiously, preferably within a period of three months from the date of filing of certified copy of the order after giving opportunity of hearing to the respondent no.4.
