  Heard learned counsel for the applicant and the learned A.G.A.

        It is submitted by learned counsel for the applicant that  on 25.8.2006 the dead body of the deceased was found in a room of the hotel but the applicant was arrested  on 29.7.2006 and from his possession a sum of Rs. 20,000/- was recovered. The recovered currency note was not bearing any specific mark to connect the same with the alleged occurrence. The applicant has not been put up for identification. There is no eye witness account. The co-accused Laxmi Narayan alias Gunga Naie  has been released on bail by this court on 14.11.2006 in criminal misc. bail application no. 24671 of 2006.

In reply of the above contention it is submitted by the learned A.G.A. the applicant belong to the family of the deceased. In case he is released on bail, he shall tamper with the evidence.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.

Let the applicant Ashok Nut  involved in case crime no. 201 of 2006 under Sections 302,394 and 411  I.P.C.,  P.S. Civil Lines   District  Etawah be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the condition that the applicant shall not tamper with the evidence and he shall  report to the court of C.J.M. concerned in the first week of each month till conclusion of the trial t  show his good behaviour.  

In default of the above condition the bail granted to him shall be deemed cancel and he shall be taken into custody by the C.J.M. concerned.
