This revision under Section 115 C.P.C., when filed, was cognizable by this Court. However, now, by virtue of C.P.C. (U.P. Amendment) Act 2003, the revision is cognizable by District Judge/Additional District Judge. As held by Division Bench authority of this court reported in Ravi Shankar Tripathi vs. Board of Revenue 2007 (102) R.D. 229 revision being only an application and not appeal, is to be decided in accordance with law prevailing at the time of hearing and not at the time of filing.
Accordingly, revision is remitted to the District Judge concerned to be heard and decided by him or any Additional District Judge of the District.
The office is directed to send the complete file to the District Judge concerned immediately.
