Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for a writ of mandamus directing the respondents not to interfere in the peaceful work of the petitioner on the post of Anganwari worker. The petitioner's case in the writ petition is that she was appointed as Anganwari worker on 2.7.2004 and thereafter she is working. Learned counsel for the petitioner submits that the petitioner heard a rumour that Bal Vikas Pariyojana Adhikari is interested to terminate the petitioner. He further contends that certain manipulations have been done in the date of birth in the High School certificate of the petitioner. The petitioner has submitted a representation dated 9.4.2007 Annexure-6 to the writ petition. The prayer of the petitioner for issuing mandamus not to interfere in the working of the petitioner has been pressed only on the basis of apprehension. No order has been passed against the petitioner affecting her working or status in so far as the representation of the petitioner regarding certain interpolation in the date of birth in High School certificate, as and when same issue is raised it is always open for the petitioner to submit reply. The respondents have not initiated any action against the petitioner. Without there being any cause of action the relief claimed by the petitioner in the writ petition cannot be granted. However, it is made clear that as and when notice is issued to the petitioner it will be open for the petitioner to submit detailed reply which will be considered in accordance with law.
