On account of failure on the part of the learned counsel for the plaintiff-appellant in taking requisite steps for issuance of notice to the respondent no.4 pursuant to the order dated 18.11.2004 passed by the Joint Registrar, the case is listed today under Chapter XII, Rule 4 of the Rules of the Court.
Case has been taken-up in the revised list. However, the learned counsel for the plaintiff-appellant is not present.
Even though the case is listed today under Chapter XII, Rule 4 of the Rules of the court, requisite steps have not been taken.
In the circumstances, there is no option but to dismiss the Second Appeal for want of prosecution as against the respondent no.4.
The Second Appeal is accordingly dismissed for want of prosecution as against the respondent no. 4.
This fact will be brought to the notice of the Court at the time of the hearing of the Second Appeal.
