1. An incident of murder of Jeet Singh had taken place on 24.7.2002 in which the petitioner was an accused and trial of this case was pending in the court of Additional Sessions Judge, Khurja. Jeet Singh's uncle Mohar Singh was doing pairvi for prosecution in that case and it is alleged that the petitioner committed murder of Mohar Singh also on 14.7.2006. The petitioner was arrested on 1.8.2006. Subsequently a detention order under National Security Act was passed against the petitioner on 21.8.2006, hence the present habeas corpus writ petition.
2. We have seen the grounds of detention. They relate to public order. The detention order states that the petitioner is trying for bail and in case he is released on bail then he is likely to repeat the incident.
3. The detention of the petitioner was approved by the State Government on 8.9.2006 and the State Government has rejected the representation of the petitioner on 28.9.2006. The Central Government has also rejected the representation of the petitioner and sent the message on 9.10.2006. There is no illegality in the detention of the petitioner. The habeas corpus writ petition has not merit. It is dismissed.
