M/S Amritsar Woollen Agency v. Presiding Officer Labour Court Kanpur & Ors. - WRIT - C No. 40149 of 2002 RD-AH 9024 (11 May 2007)
Civil Misc. Writ Petition No.40149 of 2002
M/s Amritsar Woollen Agency Versus Presiding Officer, Labour Court (V) Kanpur and others.
Hon'ble S.U.Khan J
On the persuasion of the court learned counsel for both the parties advised their clients to settle the matter through compromise. The court is glad to note that the matter has been compromised. Learned counsel / or employer respondent stated that his client was ready to pay Rs.6000/-. However, on further persuasion of the court, learned counsel agreed to pay Rs. 7500/- to the workman in full and final satisfaction of the workman's claim as awarded by the impugned award dated 18.4.2002 given by Presiding Officer, Labour Court (V) Kanpur in Misc. Case No. 66 of 1997. The awarded amount of Rs.18065/- has already been deposited by the employer; out of the said amount let the amount of Rs.7500/- be paid at once to the workman by the authority where it is deposited and the remaining amount be returned to the employer. If the said amount was kept in some interest bearing account then 40% of the accrued interest be paid to the workman and 60% of the accrued interest be paid to the respondent.
Writ petition is accordingly disposed of.
