By means of the present writ petition petitioner has prayed for quashing of impugned statement dated 10.05.2003 issued by the respondent bank. It appears that the petitioner has taken a loan from Union Bank of India, Branch Mardah, district Ghazipur. The claim of the petitioner is that the entire amount has been deposited as per the direction given by this Court in the earlier writ petition; that the petitioner is not liable to pay recovery charges still the respondent bank has debited the recovery charges from its account.
Heard Sri Mohd. Fateh, learned counsel for the petitioner and Learned Standing Counsel appearing on behalf of the respondent nos.1 to 3. No one appeared on behalf of the respondent no.4.
We afraid that the relief claimed by the petitioner in the present writ petition can be granted to the petitioner. The statement of the bank can not be quashed and no other relief has been sought by the petitioner. In the circumstances, writ petition is misconceived and is accordingly, dismissed.
