Heard counsel for the petitioner. Sri Shiv Nath Singh appears for the respondent no. 2. Sri H. R. Misra appears for the respondent no. 1. Both the counsel have agreed that this writ petition be decided finally.
By this writ petition the petitioner has prayed for mandamus directing the respondent no. 1 to conclude disciplinary proceeding against the petitioner in compliance of the order dated 14.8.2006 passed by the appellate authority. The appellate authority vide its order dated 14.8.2006 remitted the disciplinary matter to the District Administrative Committee. The grievance of the petitioner is that although the matter was remitted in August, 2006 but it has not yet been decided. The petitioner having already dismissed and the matter of disciplinary proceeding is proceeding for quite a long time, ends of justice be served in disposing of the writ petition directing the respondent no. 1 to finalise the disciplinary proceeding and take decision expeditiously preferably within a period of four months from the date of production of a certified copy of this order .
With the above observation the writ petition is dismissed.
