HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Ashok Bhushan, J.

Heard counsel for the petitioner.

By this writ petition the petitioner has prayed for quashing the order dated 22.3.2007 suspending the petitioner  who  was  working  as  Chaukidar in  the  U.P. State Road Transport Corporation Depot. The allegation against the petitioner was that on 18.3.2007 in the night shift on account of his negligence  from the Stationary room tickets were stolen.  Learned counsel for the petitioner challenging the order contended that the tickets were subsequently cancelled  and no loss was caused  tot he Corporation.  He placed reliance on the duty chart Annexure-2 to the writ petition.  The suspension having been directed in contemplation of the enquiry on allegation of negligence of the petitioner who was Chaukidar, no error can be found in the said order.  On the submissions which are sought to be raised in this writ petition it is open for the petitioner to make an application before the Regional Manager, U.P. State Road Transport Corporation, respondent no. 2 for revocation of the suspension. However, looking tot he nature of the allegation against the petitioner the Disciplinary authority  is directed to conclude the  enquiry against the petitioner expeditiously preferably within a period of four months from the date of production of certified copy of this order.

With the above observations the writ petition is disposed of.
