Petitioner's case in the writ petition is that the petitioner is to retire on 31.12.2007. An order of transfer was passed on 24.6.2006 against which the petitioner filed a writ petition No. 36692 of 2006 in which the Court directed to consider the request of the petitioner against the transfer order . The Court further directed that no adverse orders shall be passed against the petitioner till such consideration. In pursuance of the order of this Court dated 14.7.2006 the learned counsel for the petitioner submits that no order has yet been passed. Now an order has been passed for taking over the charge from the petitioner much before his retirement.
In view of the facts mentioned above and the submissions made the petitioner has made out a case for grant of an interim relief. Let counter affidavit be filed within four weeks. List thereafter.
In the mean time the impugned order dated 4.5.2007 shall remain stayed.
