Shri P.K. Gupta, Shri Ranjeet Asthana and Shri R.C. Singh have accepted notice on behalf of respondent No.2. They may file counter affidavit within three weeks. The petitioner will have two weeks, thereafter, to file rejoinder affidavit. List for final hearing on 12th July, 2007.
In the meantime and until further orders, in case the petitioner deposits 50% of the entire back wages calculated at Rs.3000/- per month from the date of dismissal of the service of the respondent upto the date of award with the Labour Court within a period of one month from today, the effect and operation of the award dated 27.12.2006 shall remain stayed. The respondent will not be permitted to withdraw the amount till further orders of the Court.
It is provided that in case the respondent-workman gives an affidavit that he is not gainfully employed anywhere, the petitioner shall either reinstates him on the last drawn wages or pay him last drawn wages every month till the conclusion of these proceedings. The payment will be made directly to the workman or through their counsel.
