Heard the learned counsel for the petitioner Sri Hitesh Pachori and the learned counsel for the respondents Sri K.K. Tiwari.
The petitioner had taken loan from respondent no.3, Branch manager Punjab & Sindh Bank, Hing Ki Mandi, Agra. The same has not been paid by the petitioner to the bank. Notices under Sections 13 (2) & (4) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002 have been issued to the petitioner for realization of the aforesaid amount. Learned counsel for the respondent-bank has vehemently opposed that installment cannot fixed by this Court as the petitioner has got an alternative remedy. The purpose of the bank would be served if we fix the installment so that the amount of the respondent be paid to the bank within a reasonable time. In these circumstances we direct the petitioner to deposit a sum of Rs.2 lacs within two months and the balance amount in 3 quarterly equal installments. In case of default the writ petition shall stand dismissed.
In case the petitioner complies with the conditional order house of the petitioner may not be auctioned.
With the aforesaid directions, the writ petition is disposed of.
