This writ petition has been filed only for seeking an interim relief not to grant fresh licence in the village as the petitioner's licence has been cancelled till the matter is decided by the Appellate Authority. A Constitution Bench of the Supreme Court in State of Orissa Vs. Madan Gopal Rungta AIR 1952 SC 12 has held that the writ petition is not maintainable only for interim relief. Similar view has been reiterated in Manjit Kaur Vs. State of Punjab & Ors. (2005) 12 SCC 310, in Special Reference No.1 of 1964 under Article 143 of the Constitution of India AIR 1965 SC 745, Amarsarjit Vs. State of Punjab AIR 1962 SC 1305, State of Orissa Vs. Ram Chandra Dev, AIR 1964 SC 685, State of Bihar Vs. Rambalak Singh "Balak" & Ors. AIR 1966 SC 1441, in the Premier Automobiles Ltd. Vs. Kamlakar Shantaram Wadke & Ors. AIR 1975 SC 2238, Maharaj Umeg Singh & Ors. Vs. State of Bombay & Ors. AIR 1955 SC 540.
In view of the above, we are not in a position to entertain this petition. It is, accordingly, dismissed.
