Heard Sri A.B.L.Gour, learned Senior learned counsel assisted by Sri Saurabh Gour, learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It has vehemently been argued by the learned counsel for the petitioner that there is no allegation of committing any fraud against the petitioner. If any allegation has been made in the impugned FIR, that may be against Vishal Sharma, the Peon of the Tahsildar but pursuant to the impugned FIR, the police is trying to effect his arrest. He is are ready to co-operate with the investigation.
Considering the facts and circumstances of the case, issue notice to respondent no.4 to file counter affidavit within four weeks. The same is also given to the investigating officer for the purpose.
List on 02.3.2007.
The investigation of case crime no. 322-C of 2006 under Section 420, 467, 468, 471 IPC PS Hathras Gate, Distt. Hathras shall go on but the arrest of the petitioner shall not be effected till the date fixed, provided he co-operates with the investigation.
However, this order may not operate parity in case of co-accused Vishal Sharma.
