HIGH COURT OF JUDICATURE OF ALLAHABAD

Crl. Misc. Writ Petition No. 6302 of 2007

Hon'ble Sushil Harkauli, J.

Hon'ble Ajai Kumar Singh, J.

We have heard learned counsel for the petitioners.

The petitioners have been arrested from the spot with the snatched chain. They have been released on bail by the Sessions Judge, Bulandshahr merely on the ground that the lady whose chain has been snatched gave an affidavit that she had fallen down and the chain had also fallen down and the accused persons had not snatched the chain.

This kind of an affidavit being given by the lady is highly suspicious and may well have been obtained by coercion or threat by other gang members.

We find nothing wrong in invoking the provisions against the petitioners under the U.P. Gangster and Anti Social Activities (Prevention) Act, 1986.

The writ petition is accordingly dismissed.
