Heard learned counsel for the revisionist and learned A.G.A.
it is contended by the learned counsel for the revisionist that the revisionist claim himself to be a juvenile. He disclosed his age in his statement recorded under section 313 Cr.P.C. as aged about 25 years. The revisionist wase released on bail on the ground of age because he was medically examined by the C.M.O. Concerned. According to the report of the C.M.O. He was aged about 19 years. The benefits of two years either side was given to the revisionist and he was released on bail. The revisionist filed an application for conducting inquiry about his age which has been rejected.
It is contended by the learned counsel for the revisionist that in case the inquiry is not conducted the revisionist shall suffer irreparable loss ultimately the defence and claim of the revisionist that he is juvenile shall remain un-adjudicated.
Considering the submissions made by the learned counsel fort the revisionist it is directed that in case the revisionist applies for conducting the inquiry within 10 days form today, the same shall be allowed and the inquiry shall be completed within 15 days thereafter. The learned magistrate shall pass appropriate order after holding the inquiry.
With this direction this application is finally disposed of.
