The grievance of the petitioner is that due to protest of the villagers, the petitioner could not be able to operate the slaughter house on a plot allotted to him for this purpose. He further submitted that he is ready to operate the slaughter house at the old premises in which his father was operating the slaughter house. In this regard, he has made a representation before the District Magistrate, Etah on 10th January, 2007.
We have heard Sri S.K.Mishra, learned counsel for the petitioner and the learned Standing Counsel.
Learned Standing Counsel submitted that the District Magistrate, Eath may be directed to decide the representation of the petitioner.
In view of the above, without entering into the merit of the case, we dispose of the writ petition requesting the District Magistrate, Etah to consider the representation of the petitioner expeditiously. While deciding the representation, District Magistrate, Etah may consider that place should not be in a residential area which may affect the residents of that area and petitioners' offer of some place which is outside the residential area which may not effect law and order and convenient to the villagers residing there, he may allow the petitioner to establish the slaughter house at such suitable place.
