Heard counsels for the parties.
A preliminary objection is raised on behalf of the contesting respondents that since the petitioner has an alternative remedy to approach the Tribunal under the bye-laws for the same relief for which the present writ petition has been filed, the petition may be dismissed on the ground of alternative remedy. This fact has not been seriously disputed by the learned counsel for petitioner.
Therefore, in view of the law laid down by the Apex Court in the case of U.P. State Bridge Corporation Ltd. Vs. U.P. Rajya Setu Nigam Karmchary Sangh, 2004 (4) SCC 268, the petition is dismissed on the ground of availability of alternative remedy without expressing any opinion with regard to the merits of the case.
