Issue notice to respondent no.  5 & 6. Learned standing counsel appears for respondents No. 1 to 4.

Learned counsel for the petitioner contends that the allegations in the order are not serious enough to merit any major punishment hence in accordance with  rule 4 (1) proviso to U.P. Government Servant (Discipline and Appeal ) Rules, 1999  suspension was unjustified.  A perusal  of the order indicate that the charges 1 and 2 were with regard to submitting recommendation by the petitioner and charge No. 3 and  4 are general in nature.

In view of the nature of the charges levelled against the petitioner, the petitioner has made out  a case for grant of interim relief.  In the mean time the impugned order dated 28.4.2007 shall remain stayed. However, enquiry proceeding shall go on.
