Repeatedly notices had been sent to the sole appellant to engage another counsel as the earlier counsel had died. The office has now reported that the notices have returned with the endorsement that the sole appellant has died. The counsel for the respondents has also moved an Abatement Application pointing out that the sole appellant died on 24th July, 1994. No counsel has put in appearance on behalf of the heirs of the sole appellant and nor any Substitution Application has been filed.

The Appeal, therefore, abates.
