Heard learned counsel for the petitioner and Sri S.K. Yadav holding brief of Sri Anuj Kumar, learned counsel for the respondent no. 5 land management committee.
The petitioner was granted an agricultural patta. It has been cancelled under Section 198 (4) of the U.P. Zamindari Abolition and Land Reforms Act. Revision of the petitioner was dismissed by the Additional Commissioner and the revision against his order has also been dismissed by the Board of Revenue. The review application and restoration application have also been dismissed. The findings is that the order in review was passed after hearing counsel. The finding in the revision is that the compliance of Rules 173 to 176 U.P. Zamindari Abolition and Land Reforms Rules, which was mandatory was not made. It has been found that Rule 173 of the U.P. Zamindari Abolition and Land Reforms Rules requires munadi to have been made at least one week before the date of the meeting. In this case the alleged munadi is said to have been done just one day before and there was no publicity. The finding is one of fact. There is no illegality in the order of the courts below. Dismissed.
