Heard learned counsel for the appellant and the learned A.G.A. for the State and perused the lower court's record.
Learned counsel for the appellant submits that there is no direct evidence against the appellant and the only evidence against the appellant is of last seen and the recovery of country made pistol. It is further submitted that the weapon is not connected with the crime and the informant did not mention about the last seen of the deceased with the appellant at the time of lodging of the report and co-accused has already been acquitted.
Considering the facts and circumstances of the case the appellant Dilayram alias Chhuttan is admitted to bail.
Pending appeal appellant Dilayram alias Chhuttan convicted in S.T. No. 459 of 1998 shall be released on bail on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders realization of fine shall also remain stayed.
