Heard counsel for the petitioner and the learned standing counsel.
By this writ petition the petitioner has prayed for mandamus commanding the respondents to consider the case of the petitioner for compassionate appointment under the The U.P. Recruitment of dependants of Government Servants Dying in Harness Rules, 1974 .
Petitioner's case is that the petitioner's father was working as Fitter in Sinchai Work Shop Izzatnagar, Bareilly who died on 22.8.2006. Petitioner after the death made an application on 4.1.2007 for compassionate appointment. Learned counsel for the petitioner submitted that with regard to similar matter this Court has already gave its judgement on 23.11.2004 in writ petition No. 4921 of 2004 Suresh Kumar Vs. Karya Prabandhak Sinchai Karyashala, Khand Izzatnagar, Bareilly & others , copy of which has been annexed as Annexure-11 to the writ petition. The petitioner's case is identical to that of Suresh Kumar. Learned standing counsel has also not disputed that the present case is covered by the above judgement dated 23.11.2004.
In view of aforesaid the writ petition is disposed of directing the respondents to consider the claim of the petitioner for compassionate appointment and dispose of the application dated 4.1.2007 expeditiously preferably within a period of two months from the date of production of a certified copy of this order.
