This petition arises out chak allotment proceedings. The submission of the petitioner's counsel is that the order dated 8.3.07 of the Dy.Director of Consolidation is an ex parte order without notice to the petitioner and without even impleading him as a party. It is stated that a restoration application has been filed by the petitioner before the Dy.Director of Consolidation but the same is not being disposed of by him.
I have heard the learned Standing Counsel and counsel for the Gaon Sabha also. In the facts and circumstances as the petitioner is pursuing an alternative remedy of restoration application, it is appropriate that the restoration application of the petitioner be disposed of. The Dy.Director of Consolidation respondent no.1 is accordingly directed to dispose of the restoration application of the petitioner at an early date. In case the petitioner files a stay application, he may also consider the same in accordance with law. With these directions, the writ petition is disposed of.
