Heard the learned counsel for the petitioner Sri Mohd.Yusuf and Sri Raj Deo Tiwari, counsel for the respondents.
It has been submitted by the learned counsel for the petitioner that the recovery against the petitioner has been issued without affording any opportunity to the petitioner. This is a question to be decided by the authorities under whom the petitioner is working as to whether any notice or opportunity has been given ? Therefore, we direct the petitioner to submit a representation within a period of three weeks from today and in case such representation is filed the same may be considered and decided by the respondents according to law within two months.
Till the decision of the representation of the petitioner, no recovery shall be made against the petitioner.
With these observations the writ petition is disposed of.
