Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for mandamus commanding the respondents to pay entire retiral benefits payable to the petitioner. The petitioner's case in the writ petition is that the mother of the petitioner who was working as class IV employee, died on 26.5.2001. Petitioner claimed to be legal heir and has submitted an application dated 1.2.2007 ( Annexure-5 to the writ petition). Learned counsel for the petitioner submits that the respondent no. 2 may be directed to consider the application of the petitioner expeditiously without expressing any opinion on the merits of the claim of the petitioner.
Ends of justice be served in disposing of the writ petition directing the respondent no. 2 to consider and take appropriate decision on the application of the petitioner dated 1.2.2007 expeditiously preferably within a period of three months. While disposing of the application of the petitioner the respondent no. 2 may also decide entitlement of the petitioner.
With the above observations the writ petition is disposed of.
