Jeetendra Kumar v. Dy. Director Of Consolidation, Jaunpur & Another - WRIT - B No. 22607 of 2007 RD-AH 9768 (22 May 2007)
Hon'ble Janardan Sahai, J.
This writ petition arises out of chak allotment proceedings. The Deputy Director Consolidation has allowed the revision of the respondent no. 2. It appears that plot no. 80 was a road side plot. The Deputy Director Consolidation has allotted the road side portion to the respondent no. 2. The petitioner has been alloted a portion of plot no. 80 but not on the road side. The demand of the petitioner is for allotment of road side land. In paragraph 14 of the writ petition it has been stated that the plot no. 80 is not original holding of respondent no. 2, which is bachat/chak marg land alloted in favour of the petitioner. The petitioner does not claim the land to be his original holding. He has therefore no right to allotment of the road side portion. The finding is that in the private partition this land was alloted to the respondent no. 2. No ground for interference has been made out. Dismissed.
