Learned counsel for the petitioner submits that although the petitioner was suspended on 8.11.2006, he was working as clerk in Nagar Panchayat, Mehdawal but the disciplinary enquiry has not yet been completed. A charge sheet has been received which has been replied by the petitioner. The suspension of the petitioner has been admittedly on the allegation of embezzlement on the ground that the enquiry is contemplated. The enquiry being pending against the petitioner, there is no error in the suspension order . However, the petitioner having submitted reply to the charge sheet, ends of justice be served in disposing of the writ petition directing the respondent to conclude the disciplinary enquiry expeditiously preferably within a period of six months.
With the above observation the writ petition is disposed of.
