Anuj Kumar v. State Of U.P. & Others - SPECIAL APPEAL DEFECTIVE No. 51 of 2007 RD-AH 979 (16 January 2007)
Hon. Dr. B.S. Chauhan, J.
Hon. Dilip Gupta, J.
This Special Appeal has been filed against the interim order dated 23rd November, 2006. A perusal of the said order indicate that after granting time to the parties to exchange the affidavits, the petition was directed to be listed on 4th January, 2007 and it was further ordered that the joining of the petitioner shall abide by the final orders to be passed in the writ petition.
Learned counsel for the appellant has not been able to impress upon us any ground that may call for any interference against the said interim order. He has, however, urged that the writ petition may be disposed of at an early date as he shall soon file the rejoinder affidavit to the counter affidavit that had been filed on behalf of some of the respondents.
We, therefore, dismiss this Special Appeal and request the Learned Judge to dispose of the writ petition at an early date subject to the convenience of His Lordship.
