Heard counsel for the petitioner and learned counsel appearing for the respondents.

Since the petitioner has equally efficacious remedy of filing appeal under the relevant service rules against the order impugned in this writ petition, we decline to interfere with the order at this stage in exercise of jurisdiction under Article 226 of the Constitution of India without entering into the merits of the case.

In case the petitioner files an appeal within a period of one month from today, the same shall not be dismissed only on the ground of delay and laches.

Petition is dismissed.
