Heard counsel appearing on behalf of the petitioner and Sri J.S.Tomar, Standing Counsel.

It appears from the order dated 19.4.2007 that learned counsel for the petitioner had stated that Sri Ram Naresh, the then District Inspector of Schools had demanded Rs. 25,000/- for issuing appointment letter to the petitioner after approval to the appointment of the petitioner was granted by the erstwhile District Inspector of Schools on 11.3.1996. On the basis of the aforesaid  allegation presence of Sri Ram Naresh was directed to be ensured on 15.5.2007 along with record to explain as to why he has not issued appointment letter to the petitioner when his appointment was approved by the erstwhile District Inspector of Schools.

On 15.5.2007 Sri Sandeep Mukherjee, learned Standing Counsel informed the Court that he had informed Sri Ram Naresh, District Inspector of Schools about the order by fax dated 30.4.2007 though the Secretary, Department of Education, Government of U.P. , Lucknow. Learned counsel for the petitioner had stated on 15.5.2007 that Sri Ram Naresh has now been transferred to some other place whereupon Sri Sandeep Mukherjee was directed to inform the Court on the next date about the present posting of Sri Ram Naresh from the office of Secondary Education, Government of U.P., Lucknow.

When the case was taken up today in the revised list the Standing Counsel Sri J.S.Tomar informs that he vide letter dated 18.5.2007 had informed the Secretary (Education), Government of U.P., Lucknow regarding the order passed by this Court failing which adverse orders are likely to be passed in case Sri Ram Naresh does not appear in Court on the next date of listing, i.e., 23.5.2007 in pursuance of the order passed by the Court. He has also informed the District Inspector of Schools for filing compliance report on or before 23.5.2007.

The letter dated 18.5.2007 sent by the Standing Counsel Sri J.S.Tomar is as under: -

Please take reference of my speed post letter dated 1.5.2007 but no response has yete been received till today.

Again on 15.5.2007 the above noted writ petition was listed before this Hon'ble Court and after hearing the cousnel for the partires, the Hon'ble Court has directed to the Secretary, Education U.P. Government Lucknow to inform the D.I.O.S., Farrukhabad to comply the order dated 19.4.2007 and 15.5.2007 passed by this Hon'ble Court, failing which any adverse orders are likely to be passed and has further directed that the case will be listed on 23.5.2007 for further orders.

It is, therefore, requested to inform or send the D.I.O.S., Farrukhabad  for filing the compliance report of the orders as mentioned above on or before 23.5.2007, failing which any adverse orders are likely to be passed against the respondents.

Please ensure the compliance of the order of this Hon'ble Court and do the needful accordingly.

The District Inspector of Schools, Farrukhabad by letter dated 22.5.2007 has informed Sri J.S.Tomar in response to his faxed letter dated 18.5.2007 that the then District Inspector of Schools, Farrukhabad Sri Ram Naresh has been informed to be present in Court on 15.5.2007. A copy of the faxed letter dated 25.4..2007 was also appended alongwith another letter of the District Inspector of Schools, Farrukhabad dated 8.5.2007 to Sri Ram Naresh, the then District Inspector of Schools, Farrukhabad. When the case was taken up today learned Standing Counsel informs that Sri Ram Naresh has neither communicated nor has appeared before the Court. He further states that Sri Ram Naresh is said to have been retired and is living at Village and Post Bijapur, Jhangtaur District Deoria, Pin Code No. 274508

In the circumstances, this Court has no option but to issue bailable warrant for securing the presence of Sri Ram Naresh to be present before this Court on 3.7.2007. The bailable warrant may be served upon Sri Ram Naresh through the Chief Judicial Magistrate, Deoria at his residential address above within 15 days from today. If he is not found at Deoria his present address from where he is drawing his pension etc. be determined from the office of the Secretary (Education), Government of U.P., Lucknow and a report shall be filed in this regard by the next date of listing.  

A copy of this order shall be sent by fax to the Chief Judicial Magistrate, Farrukhabad within three days for compliance. He will also submit the report of service within a period of 15 days. The report shall be submitted before the Bench in the jurisdiction in Summer Vacation.
