Heard counsel for the petitioner and Sri Ashok Malviya counsel for the caveator.

This petition has been filed against an order of the Dy.Director of Consolidation dated 21.3.07 whereby he has set aside the order of the Asstt. Settlement Officer, Consolidation and has remanded the case to him for fresh decision. It appears that the case had been decided on the basis of a compromise. By the said compromise the respondent no.2 is said to have given her house,well etc. The respondent no.3 Smt. Chhabbi denied the compromise. She alleged that she never put her thumb impression. The case has been sent back to the Consolidation Officer to examine the question of compromise and for fresh decision. The petitioner will have opportunity to put forward his case.. No ground for interference under Article 226 of the Constitution of India has been made out. Dismissed.
