The counsel for the petitioner submits that in the departmental inquiry the petitioner has not been found guilty as per Annexure 3.
Issue notice.
Notice on behalf of respondents no. 1, and 2 has been accepted by the learned A.G.A. Sri N.S. Chahar has accepted notice on behalf of respondent no. 3. They pray for and are granted a month's time to file counter affidavit and rejoinder affidavit may be filed within three weeks thereafter.
List this petition for admission after expiry of the aforesaid period.
In the meantime, investigation may be continued but the petitioner will not be arrested in case crime no.227/2007 under sections 420, 467 and 468, I.P.C. police station Tundla district Firozabad till the next date of listing or till submission of the police report under section 173 Cr.P.C., whichever is earlier.
However, this interim order will not affect the continuance of disciplinary proceedings against the petitioner.
