Heard Sri A.R. Dube, learned Counsel for the petitioners and Sri Ranjit Saxena, learned Counsel for the respondents.

The writ petition has been filed raising large number of grievances regarding amount of electricity dues.

Sri Ranjit Saxena, learned Counsel for the respondents has submitted that the petition raises highly disputed question of fact and law, and as they are mixed questions of law and fact, therefore, it is desirable that in case the copy of this petition is placed before the Executive Engineer, Southern Vidyut Vitran Nigam Limited, Sikohabad, Firozabad, i.e. respondent no. 1, it shall be treated as representation under the provisions of U.P. Electricity Supply Code, 2005 and shall be decided in accordance with law.

In view of the submissions made by Sri Saxena, we dispose of this petition directing the petitioner to place the copy of the writ petition before the leaned Executive Engineer, Southern Vidyut Vitran Nigam Limited, Sikohabad, Firozabad, i.e. respondent no. 1, who shall treat it as a representation and decide the same as per the provisions contained in Code, 2005 expeditiously. A copy shall be filed before the said learned Authority along with certified copy of the order within a period of one week from today and it shall be decided within three weeks thereafter.

For a period of four weeks, no coercive measure shall be taken against the petitioner for making the recovery.
