Proceedings under Section 34 of the Land Revenue Act were pending. It appears that an entry was made in P.K. 11 in the name of the of the petitioner in place of Smt. Asharfi Devi. That order was stayed by an order of the Tehsildar on 22.1.2004. The petitioner challenged that order in revision in the Board of Revenue, which has been dismissed. The order of the Tehsildar is an interlocutory one. The view taken by the Board of Revenue that the entry in P.K. 11 during the pendency of the proceedings for mutation was not a valid order does not suffer from any error, as the mutation case is still pending before the Tehsildar. Counsel for the petitioner then prayed that the Tehsildar be directed to dispose of the mutation case at an early date. It is stated that all the parties are represented. In the facts and circumstances of the case the Tehsildar shall try to dispose of the case expeditiously in accordance with law after opportunity to the parties.
With the above directions the writ petition is disposed of finally.
