Smt. Shailesh Srivastava v. The Union Of India & Others - SPECIAL APPEAL DEFECTIVE No. 470 of 2007 RD-AH 9965 (23 May 2007)
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Rajes Kumar, J
Heard on merit.
The learned Single Judge vide judgment and order dated 7th November, 2006 dismissed the writ petition of the appellant-petitioner claiming compassionate appointment in the bank on the ground that the bank has changed the scheme and it provides only ex-gratia lump sum amount in lieu of the compassionate appointment, as the bank itself opted the policy not to grant compassionate appointment. The Court does not have power to take a contrary view. Thus, there is no cogent reason to interfere in the matter. The appeal lacks merit and is, accordingly, dismissed. However, it shall be open for the appellant to claim ex-gratia lump sum amount from the bank as directed by the learned Single Judge.
