IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CWP NO.20250 OF 2005
DATE OF DECISION: 23.12.2005
K.S. Yadav ... Petitioner.
The Haryana State Small Industries & Export Corporation Limited ..Respondent.
CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR.JUSTICE VIRENDER SINGH
PRESENT: Mr. B.B. Sharma, Advocate for the petitioner.
J.S. Khehar, J. (oral)
Through the instant writ petition, the petitioner claims GIS as well as leave encashment which have been denied to him despite the fact that the services of the petitioner were retrenched as far back as 1.7.2002.
On the issue in hand, the petitioner is stated to have submitted a legal notice dated 10.9.2005 (Annexure P3). It is, however, contended that no decision has been taken thereon till date.
Learned counsel for the petitioner states that the petitioner would be satisfied if the respondent is required to take a final decision on CWP NO.20250 OF 2005 2
the legal notice dated 10.9.2005 (Annexure P3).
In view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing the respondent i.e. the Managing Director, Haryana State Small Industries and Export Corporation Limited, to take a final decision on the legal notice dated 10.9.2005 (Annexure P3) by passing a well reasoned speaking order within three months from the date of receipt of a certified copy of this order. In case the petitioner is found entitled to any monetary benefits, the same shall be calculated and released to the petitioner within a further period of one month.
Disposed of accordingly.
Order dasti on payment of usual charges.
