UTTAR HARYANA BIJLI VITRAN NIGAM AND OTHERS V.
PRESENT: Shri Surinder Lamba, Advocate, for the appellants.
For the reasons stated in the application, the delay in filing the appeal is condoned subject to all just exceptions.
Contends that the plaintiffs had claimed compassionate appointment on the ground of death of his father which had occurred in the year 1991 whereas the suit has been filed in the year 2000. It has been claimed that the aforesaid suit was beyond limitation. It is further contended that the claim of the plaintiff was rejected on July 16,2001 on the ground that he was not eligible. The aforesaid order has never been challenged by RSA 10 of 2006(O&M) 2
the plaintiff, at any stage. Accordingly, it is contended by the learned counsel that the findings recorded by the learned courts below are judicially perverse and not sustainable.
Execution of the decree under appeal shall remain stayed till further orders.
