SURINDER PAL SINGH v. STATE TRANSPORT COMMISSIONER, PUNJAB AND - CWP-922-2006 [2005] RD-P&H 317 (23 December 2005)

CWP No.922 of 2006 Page numbers

In the High Court of Punjab and Haryana, Chandigarh.

CWP No.922 of 2006

Date of decision:20.1.2006

Surinder Pal Singh

....Petitioner

Versus

State Transport Commissioner, Punjab and others.

....Respondents.

Coram:- Hon'ble Mr.Justice J.S. Khehar.

Hon'ble Mr. Justice S.K. Mittal

Present: Mr. B.S. Giri, Advocate

for the petitioner.

...

J.S. Khehar, J. (Oral).

Through the instant writ petition, the petitioner seeks issuance of a writ in the nature of mandamus so as to direct the State Transport Commissioner, Punjab (respondent No.1) to take a final decision on the application filed by him on 18.1.2005 (Annexure P-1), seeking the grant of extension of his route upto Sirhind from Gurdwara Shaheed Sukha Singh via Fatehgarh Sahib and diversion to operate it via Ranuan Adda instead of going via Amrala, Maheshpura route. It is the contention of the learned counsel for the petitioner, that after the petitioner submitted the aforesaid application dated 18.1.2005, he also addressed a representation dated CWP No.922 of 2006 Page numbers

8.8.2005 (Annexure P-2) to the respondents. However, no decision has been taken thereon till date.

Learned counsel for the petitioner states, that the petitioner will be satisfied, if the instant writ petition is disposed of with a direction to respondent No.1 i.e. the State Transport Commissioner, Punjab, requiring him to take a final decision on the petitioner's application dated 18.1.2005 (Annexure P-1).

In view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.1 i.e. the State Transport Commissioner, Punjab, to take a final decision on the petitioner's application dated 18.1.2005 (Annexure P-1) by passing a well reasoned speaking order, within two months from the date of receipt of a certified copy of this order.

Disposed of accordingly.

Order dasti on payment of usual charges.
