The petitioner has filed the present writ petition wherein it has been prayed that the orders, Annexure P-3 passed by respondent no.1 by which the petitioner was suspended as Sarpanch, Gram Panchayat, Village Papra, Block Punhana, District Gurgaon, be quashed.
Mr.Sanjeev Bansal, learned Additional Advocate General, Haryana, states that fresh elections to the post of Sarpanch in the State of Haryana have already been conducted and as such this writ petition has been rendered infructuous. It is further submitted that in case any penalty is imposed on the petitioner in the regular inquiry which is being conducted, then the petitioner will have fresh cause of action to file reply in the regular inquiry.
In view of the fact that fresh elections to the post of Sarpanch in the State of Haryana have already been held, we find that the present writ petition has been rendered infructuous. The same is dismissed as such.
