Vide order, under challenge, application of the respondents, who are none other than the widowed daughter-in-law and grand son of the petitioner, was accepted and they were allowed to continue with their suit, claiming maintenance from the petitioner, as indigent persons. This Court is of the view that the order passed is perfectly justified. To say that the respondents are indigent persons, reliance has been placed upon the evidence, led by the parties. Assertion of the petitioner that respondent No. 1 owns bank balance and a Maruti car is not acceptable, as no evidence was led by him in that regard. No case is made out to interfere. Dismissed.
