Petitioner Bala has filed this petition under Section 439 Cr.P.C.
for grant of regular bail in case FIR No.26 dated 28.4.2006 registered under Sections 304-B/498-A/34 IPC at Police Station Salhawas (Jhajjar).
I have heard the counsel for the parties and perused the contents of the FIR.
Counsel for the petitioner contends that at present the petitioner is at the advance stage of pregnancy. She is in custody since 1.5.2006.
Counsel further contends that the petitioner is married sister-in-law of the deceased. She was married more than 15 years ago and was living was her husband at Delhi. It is the case of the petitioner that she has nothing to do with the alleged demand of dowry and the alleged suicide committed by the deceased. Even in the alleged dying declaration, there is no allegation that at any point of time the petitioner demanded any dowry. Counsel contends that the brother-in-law of the deceased has already been granted regular bail and mother-in-law of the deceased is still in custody. The pregnancy of the petitioner of seven months has not been disputed by the State counsel. The trial is not going to conclude soon as till date no prosecution witness has been examined.
Keeping in view these facts, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner, and she is accordingly ordered to be released on bail to the satisfaction of the trial Court.
