Petitioner Sadhu Singh has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 166 dated 2.8.2003 registered under Section 420 IPC at Police Station Jagraon, District Ludhiana.
Counsel for the petitioner contends that the petitioner is in custody since 15.9.2006. The case is to be tried by the Magistrate. The allegation against the petitioner is that he along with other co-accused have sold the mortgaged property, though a suit for recovery is pending before the Civil Judge, Jagraon. Counsel further contends that the petitioner was not having any knowledge about the pendency of the case, therefore, he did not appear before the trial Court and was declared Proclaimed Offender.
Counsel contends that now the petitioner is ready to furnish heavy surety with an undertaking that in future he will regularly appear before the trial Court.
Keeping in view the aforesaid facts, I deem it appropriate to grant regular bail to the petitioner, and he is accordingly ordered to be released on bail to the satisfaction of CJM, Ludhiana, subject to his furnishing heavy surety with an undertaking that in future he will regularly appear before the trial Court.
