The petitioners apprehending their arrest in a non-bailable offencein case FIR No.125 dated 24.8.2006 registered under Sections 452/323/324/148/149 IPC at Police Station Julkan, District Patiala, have filed this petition under Section 438 Cr.P.C for grant of anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioners contends that no injury has been attributed to the petitioners and the only allegation against them is that they were present on the spot. Counsel further contends that the only non- bailable offence is under Section 452 IPC.
Counsel for the petitioners further contends that in view of the order dated 28.9.2006, the petitioners have joined the investigation.
Counsel for the respondent does not dispute this face and further states that the petitioners are no more required for custodial interrogation as during the investigation by the DSP, they were found innocent.
In view of the above, the interim bail, granted vide order dated 28.9.2006 is made absolute.
Disposed of accordingly.
