The petitioners, along with some other candidates, filed CWP No.1302 of 2005, which was disposed of by this Court on September 16,, 2005 with a direction that the respondents shall consider their claim for appointment in the light of various judgments, which are referred to in the above stated order, within a period of three months.
Alleging non-compliance of the above stated order, this contempt petition has been filed.
In response to the show cause notice, an affidavit has been filed by Mr. Anand Sharma, Director, Elementary Education, Haryana and along with the said affidavit, he has also appended copies of the orders dated 5.6.2006 (Annexures R1 to R5) whereby the claim of the petitioners for appointment has been duly considered and turned down on the ground that COCP No. 269 of 2006 -: 2 :-
they are in the waiting list and candidates higher in merit than these petitioners are still awaiting appointments.
In this view of the matter, the directions issued by this court having been complied with, this petition is disposed of with liberty to the petitioners to impugn the orders vide which their claim for appointment has been turned down, if so required and/or advised.
