The petitioner filed Crl. Misc.33819-M of 2006, which was disposed of on May 31, 2006 with liberty to the petitioner to approach the Senior Superintendent of Police, Jalandhar and SHO of the concerned Police Station, who was further directed to "take appropriate action in accordance with law".
Alleging non-compliance of the above stated order, this contempt petition has been filed.
On September 15, 2006, Learned State Counsel was asked to get instructions in the matter.
Pursuant thereto, an affidavit dated 10.11.2006 of Ishwar Singh, SSP, Jalandhar has been filed, which is taken on record.
As per the averments made in the affidavit, the petitioner's COCP No.1220 of 2006
complaint was got inquired into from DSP(D), Jalandhar and the said inquiry report was legally got examined from the District Attorney (Legal), Jalandhar and thereupon it has been found that no cognizable offence is made out.
In this view of the matter and having regard to the fact that the petitioner's complaint has been duly enquired into by the respondents, this petition is disposed of with liberty to the petitioner to have any other recourse for redressal of his grievance, as may be permissible in law, if so advised.
