Learned Counsel for the respondents states that, as per the written instructions received by him, in compliance to the order dated 14.7.2005 passed by this Court, the claim of the petitioner for promotion has been reconsidered and after reinstating him, he has been promoted to the rank of Naib Subedar (GD) with effect from 1.6.2002 along with his batch- mates. A copy of the above said letter dated 5.6.2006 has been placed on record. In para 5 thereof, it has been mentioned that:- "Action regarding entitlement of arrears of pay and allowances and adjustment of amount drawn as pension and gratuity etc.
may please be settled with PAO (OR) BEG & Centre Roorkee accordingly."
In this view of the matter and having regard to the fact that the directions issued by this court have been substantially complied with, this COCP No.1251 of 2005 -: 2 :-
petition is disposed of with a direction to the respondents to take necessary action in terms of para 5 of their letter dated 5.6.2006 and to release the consequential benefits, including arrears of pay and allowances, in favour of the petitioner within three months, if already not released.
